§2 Data We Collect

WebCodeSystems collects the following categories of personal data:

Identity Data: Full name, company name, job title provided through contact forms.

Contact Data: Email address, phone number, physical address provided during project engagement.
•
Technical Data: IP address, browser type/version, operating system, referring URLs, and page interaction data collected automatically through server logs.
•
Project Data: Business requirements, technical specifications, and source code shared by clients during active engagements under NDA.
•
Payment Data: Transaction IDs and billing information processed exclusively through Stripe. We do not store credit card numbers on our servers.

§3 How We Process Your Data

We process personal data under the following legal bases as defined in Article 6 of the GDPR:

Contractual Necessity (Art. 6(1)(b)): Processing required to fulfill our contractual obligations when you engage WebCodeSystems for development services.
•
Legitimate Interest (Art. 6(1)(f)): Processing for direct marketing, service improvement, fraud prevention, and IT security measures.
•
Consent (Art. 6(1)(a)): Where you have given explicit consent for specific processing activities such as newsletter subscriptions.

§4 Data Sharing & Third Parties

WebCodeSystems does not sell your personal data. We share data only with the following categories of processors:

Infrastructure Providers: Cloud hosting providers (AWS, GCP, or DigitalOcean) for data storage and application deployment, all operating under Standard Contractual Clauses.
•
Payment Processors: Stripe for payment transaction processing. Stripe operates under their own GDPR-compliant privacy policy.
•
Communication Tools: Email service providers for transactional and project-related communications.
•
Legal Authorities: When required by law, court order, or regulatory obligation under Spanish and EU law.

§5 Data Retention

Personal data is retained only for as long as necessary to fulfill the purposes for which it was collected:

Contact Form Submissions: Retained for 24 months from the date of submission for follow-up purposes.
•
Project Data: Retained for the duration of the project engagement plus 12 months post-completion for warranty and support obligations.
•
Server Logs: Automatically purged after 90 days.
•
Financial Records: Retained for 6 years as required by Spanish tax law (Ley General Tributaria).

Under the GDPR and Spanish data protection law, you have the following rights:

Terms of Service

These Terms of Service ("Terms") govern your use of services provided by WebCodeSystems ("we," "us," or "our"), a web development company registered at Calle Alameda Principal 10, 29005 Malaga, Spain. By engaging our services, you agree to be bound by these Terms.

§ 1. Scope of Services

WebCodeSystems provides custom full-stack web development services including but not limited to: web application development, e-commerce platform engineering, API integration, cloud infrastructure setup, database architecture, performance optimization, security auditing, and system modernization. All services are delivered as described in the individual project proposals and statements of work agreed upon by both parties.

§ 2. Project Engagement & Proposals

•
Each project begins with a detailed proposal outlining scope, deliverables, timeline, and fixed pricing.
•
Proposals are valid for 30 calendar days from the date of issue.
•
Work commences only after written acceptance of the proposal and receipt of the agreed deposit (minimum 30% of total project value).
•
Scope changes requested after project kickoff will be documented as change orders with separate pricing and timeline adjustments.

§ 3. Payment Terms

•
All prices are quoted in Euros (EUR) and are exclusive of applicable taxes unless explicitly stated.
•
Payment is due within 14 days of invoice date unless otherwise agreed in writing.
•
Late payments accrue interest at the statutory rate of 8% per annum plus applicable recovery costs under EU Directive 2011/7/EU.
•
All payments are processed securely via Stripe. WebCodeSystems does not store payment card details.

§ 4. Intellectual Property

•
Upon full payment, all custom source code, designs, and documentation created specifically for the client become the intellectual property of the client.
•
WebCodeSystems retains the right to use general methodologies, frameworks, and non-proprietary tools developed during the engagement for future projects.
•
Third-party libraries and frameworks remain subject to their respective open-source or commercial licenses.

§ 5. Warranties & Limitations

•
WebCodeSystems warrants that all deliverables will conform to the specifications outlined in the accepted proposal.
•
A 30-day post-launch warranty period is included, covering defects in delivered functionality.
•
We do not warrant uninterrupted or error-free operation of third-party services, hosting environments, or client-modified code.
•
Our total liability under any engagement shall not exceed the total fees paid by the client for the specific project in question.

§ 6. Confidentiality

Both parties agree to maintain strict confidentiality of all proprietary information shared during the engagement. This includes business logic, source code, trade secrets, client data, and project specifications. Confidentiality obligations survive termination of the engagement for a period of 3 years.

Either party may terminate with 14 days written notice.
•
Upon termination, the client is invoiced for all work completed up to the termination date.
•
WebCodeSystems will deliver all completed work and source code upon receipt of outstanding payment.

§ 8. Governing Law

These Terms are governed by Spanish law. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Malaga, Spain, without prejudice to the consumer's right to bring proceedings in their domicile as permitted under EU Regulation 1215/2012.

Refund & Reimbursement Policy

This Refund Policy outlines the terms and conditions under which WebCodeSystems ("we," "us," or "our"), registered at Calle Alameda Principal 10, 29005 Malaga, Spain, provides refunds for services rendered. This policy is in accordance with Spanish consumer protection law (Real Decreto Legislativo 1/2007) and EU Directive 2011/83/EU on consumer rights.

§ 1. General Refund Conditions

•
All services provided by WebCodeSystems are custom-developed digital services. Due to the nature of bespoke software development, standard withdrawal rights under EU consumer law (14-day cooling-off period) do not apply once work has commenced with the client's explicit consent.
•
If you cancel a project before work has begun, you are entitled to a full refund of any deposits paid within 14 days of the cancellation request.
•
If you cancel after work has commenced, refunds are calculated proportionally based on completed milestones.

§ 2. Milestone-Based Refund Calculation

For projects structured around milestones:

•
Completed milestones that have been delivered and accepted are non-refundable.
•
Deposits for in-progress or unstarted milestones are refundable minus a 10% administrative fee.
•
Any intellectual property delivered in completed milestones remains with the client upon payment.

§ 3. Defective Deliverables

If delivered work materially fails to meet the specifications outlined in the accepted proposal:

•
WebCodeSystems will first attempt to remedy the defect within a reasonable timeframe (up to 30 days).
•
If remediation is not possible or is not completed within 30 days, the client is entitled to a proportional refund for the defective deliverable.
•
Refund requests for defective deliverables must be submitted within 30 days of delivery.

§ 4. Non-Refundable Items

•
Third-party licensing fees, hosting fees, or domain registration costs incurred on behalf of the client.
•
Consulting or advisory services that have been delivered and documented.
•
Work completed under approved change orders.

§ 5. Refund Process

•
Refund requests must be submitted in writing to [email protected].
•
We will acknowledge receipt within 2 business days and provide a resolution within 14 business days.
•
Approved refunds are processed via the original payment method within 5 business days of approval.
